What a constitutional scholar you are, Krell! I guess then, by the very omission of the mentioning of territories and protectorates, the Constitution says McCain is not fit for office. But if that's true, the hypocrisy on the media's part is all the more blatant. The TV media--except for FOX--loves Obama. And yet those people who love Obama have had to address Rev. Wright and Obama's birth certificate issue. Where's the scrutiny of McCain? Why did Judicial Watch's inquiry into the Rothschild meeting get untouched? Why is the FEC still shut down? Why did Rick Warren hold his farce before the convention, giving people time to get excited over McCain's readiness and strong conviction? Why was the VP pick a conservative named Sarah Palin? Why is the gas price issue eclipsing the Iraq War? All of this does McCain enormous favors in conservatives' eyes, and in most of the rest of Americans' eyes, as well.

The problem isn't the Constitution it's the belief out there that the Constitution is a framework with gaps that have to be filled in by laws. As mentioned elsewhere it is Title 8 of the U.S. Code that apparently is allowing McCain to run. Since his parents apparently had a residence in the U.S. while serving in the Canal Zone section 1401C applies. Note that if it was actually 1403 (which would be the case if there was no residence) it would be a fair assumption that he isn't eligible to run. It is the same Section that is allowing Obama to run unless information is being held showing otherwise.

So do the laws enabling McCain to run as a naturalized citizen defy the Supreme Law of the Land, or clarify it? In other words, is that law which Brad mentioned a good one, or one that should be disregarded due to possible contradiction of the Constitution?

Yeah--but it sure pressures a lot of people into voting McCain, because he doesn't seem as "foreign" or "illicit". Although he was born in Panama. And the only physical place of birth the 14th Amendment deals with is the "State" (as in one of the United States) wherein you are born. It doesn't mention protectorits, territories, or militarty bases... It's the first time in U.S. history, that I can find to date, where two aliens are allowed to run for President. Kind of adds a twist to the term Criminal Alien, eh?
